Administrator of personal data

The administrator of your voluntarily provided personal data is SI-Consulting Sp. z o.o. with its registered office in Wrocław (50-304), ul. A. Słonimskiego 1 (hereinafter referred to as SI-Consulting Sp. z o.o.).

If you have any doubts regarding the processing of your personal data, you should first address your questions to the Administrator or to the Data Protection Inspector.

Purposes, legal basis and duration of the processing of personal data

Your personal data, will/may be processed for the following purposes:

  • To undertake marketing activities and send commercial information to the Administrator on the basis of your consent to the processing of your personal data (Article 6(1)(a) RODO), as well as your consent to receive such information by means of electronic communication (e-mail) - in accordance with the provisions of the Act on the provision of services by electronic means and the Telecommunications Law. Once you have given your consent, the Administrator will be able to send you commercial information by means of electronic communication (e-mail) or contact you on the telephone number you have provided (telephone, text message). In this case, your personal data will be processed until the above purpose is fulfilled or until any of the consents given are withdrawn. The provision of personal data is voluntary, but necessary to receive commercial information from the Administrator,
  • for establishing, investigating or defending against possible claims and for demonstrating the accountability of the Administrator's actions referred to in Article 5(2) of the RODO (for the fulfilment of the Administrator's legitimate interests in the form of securing claims and ensuring accountability, on the basis of Article 6(1)(f) of the RODO, until the statute of limitations for claims under generally applicable legislation.

For the purposes of the above, your personal data will not be subject to decisions based on automated processing, including profiling. You can withdraw your consent by contacting the Administrator at the following email address: iod.sic@si-consulting.pl. Please also be informed that the withdrawal of consent will not affect the actions that the Administrator has taken before the consent was withdrawn.

Recipients of data - to whom the Administrator may forward personal data

SI-Consulting Sp. z o.o. will transfer your personal data to other recipients entrusted with the processing of personal data on behalf and for the benefit of SI-Consulting Sp. z o.o.. Entities entrusted with the processing of your personal data fall, in particular, into the category of infrastructure solution providers and may process your personal data within the meaning of the RODO, in a third country. These entities may also use further entities to process your personal data in a third country. The categories of recipients to whom SI-Consulting Sp. z o.o. has entrusted the processing of personal data also include, but are not limited to: its subcontractors, suppliers and external entities cooperating with SI-Consulting Sp. z o.o. that provide services such as accounting, consulting, administrative services. Your personal data may therefore also be transferred to a country outside the European Economic Area (EEA) and be processed there. Any transfer of personal data is carried out in accordance with applicable law. Your data may be transferred to third countries and international organisations where entities based in these countries have implemented appropriate safeguards for the processing of personal data. If personal data is transferred outside the EEA, SI-Consulting Sp. z o.o. applies the Standard Contractual Clauses as a security measure for countries where the European Commission has not established an adequate level of data protection.

In addition, SI-Consulting Sp. z o.o. will share your personal data with other recipients, if such an obligation arises from the law or the sharing arises from the relationship between you and SI-Consulting Sp. z o.o..

Your rights

You have the following rights in relation to the processing of your personal data by the Controller:

  •  The right of access to your personal data

You have the right to request information at any time about how we process your personal data. To obtain such information, please contact us by the means of communication indicated in this clause.

  • right to rectification of personal data

You have the right at any time to request the rectification of your personal data if it is incorrect, and to complete incomplete data. You can update your personal data by notifying us of your need to do so, using the means of communication indicated in this clause.

  • right to erasure of personal data (to be forgotten)

You have the right to delete the personal data we process about you at any time. Please bear in mind that this right is not absolute and that we, as Administrator, may refuse to erase those data for which we have a basis for further processing.

  • right to request restriction of processing

You have the right to request at any time the restriction of the processing of personal data concerning you, taking into account the following conditions:

- if you object to the processing of your personal data processed on the basis of a legitimate interest of the controller (Article 6(1)(f) RODO), in which case we will restrict any processing of such data after verifying the legitimate interest and making a case-by-case assessment.

- if you notify us that the personal data we are processing is incorrect, out of date or incomplete, we will restrict any processing of that data until we have verified its accuracy.

- if we process your data unlawfully and you have objected to erasure.

- if the purpose of the processing has been achieved by the Controller, but the data is required by you to establish, assert or defend a claim.

  •  right to object to processing

When the processing is carried out on the basis of Article 6(1)(f) RODO i.e. the legitimate interest of the Controller - you have the right to object at any time to the processing of personal data concerning you. We will then cease processing your personal data unless we can find a lawful justification for doing so that demonstrates the superiority of your interest or right. You will be informed of this fact.

  •  right to data portability

In the case of processing based on Article 6(1)(a) RODO i.e. consent - you have the right to data portability, including receiving from the Controller in a structured, commonly used format the data you have provided to the Controller, where the basis for the processing was the consent of the data subject (Article 6(1)(a) RODO), or the processing is necessary for the performance of a contract to which the data subject is party or to take steps at the request of the data subject prior to entering into a contract (Article 6(1)(b) RODO). The right also exists because the processing is carried out by automated means.

  • The right not to be subject to a decision based solely on automated processing, including profiling

You have the right not to be subject to a decision which is based solely on automated processing, including profiling, and which produces legal effects on you or similarly significantly affects you.

  •  right to withdraw consent

You have the right to withdraw your freely given consent at any time, but without affecting the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.

  • The right to lodge a complaint with the President of UODO

You have the right to lodge a complaint with the President of the Office for the Protection of Personal Data if you consider̨ that the processing of your personal data violates the provisions of the data protection law.
